INTRODUCTION

Erkan & Sullivan, P.C. obtains consent for transactional SMS messaging exclusively through its intake process. The image below shows the intake form used by the Firm, including the SMS consent disclosure presented to clients.

HOW CONSENT IS OBTAINED

During intake, a staff member reads the SMS consent disclosure to the client and confirms the client’s agreement to receive transactional SMS messages. The staff member then records the client’s consent by selecting the SMS consent checkbox on the intake form on the client’s behalf. The Firm maintains records of this consent as part of its intake documentation.
