Ryan Sullivan is a criminal defense attorney based in Andover, Massachusetts. Lowell Roots

Ryan Sullivan grew up in Tewksbury, Massachusetts, with deep roots in the Merrimack Valley. His family has been part of this community for generations — his grandfather served as a state representative for the region, his great-uncle was the Tewksbury Chief of Police (the new police station bears his name), and his father was a columnist for the Lowell Sun for years, writing about the community Ryan would go on to serve as a lawyer.

Ryan didn’t end up practicing in Lowell and Lawrence by accident. He grew up watching the Merrimack Valley’s courts, institutions, and people. He knows the region — its history, its challenges, and its character — in a way that cannot be learned from a firm bio. When clients in Lowell call him, they’re not calling a suburban attorney who occasionally appears in the Lowell courts. They’re calling someone who grew up here.

Former Prosecutor: Award-Winning Trial Work in Middlesex County

Ryan began his legal career as a prosecutor in the Middlesex County District Attorney’s Office, appearing in both the Middlesex County District Courts and Middlesex Superior Court. He was recognized for the quality and success of his trial work — receiving the John Droney District Court Award, given for exemplary service in the district courts of Middlesex County and nominated by his peers. Former Middlesex District Attorney Gerard T. Leone said: “Ryan is a dedicated lawyer and truly valued colleague. His prosecution experience gives him an insider’s advantage that is genuinely rare: he has been in the room where charging decisions are made, where trial strategy is developed, and where deals are offered and declined. He knows how prosecutors think about cases — not as an observer, but as someone who did that work. That knowledge is what he brings to the defense of every client.

Both Ryan and his partner Murat Erkan began their careers as prosecutors in the busiest courts in the Commonwealth before building a firm known for uncompromising defense. Together they bring more than forty years of combined experience — including extensive prosecution and defense work in Middlesex and Essex counties.

Areas of Specialized Expertise

Post-Bruen Firearms Defense and Commonwealth v. Guardado

Since the U.S. Supreme Court’s 2022 decision in New York State Rifle & Pistol Association v. Bruen and the SJC’s 2023 ruling in Commonwealth v. Guardado, Massachusetts firearms defense has changed fundamentally. The burden of proof shifted: the Commonwealth must now prove lack of a valid license as an essential element of the crime.

Ryan has been litigating at the front edge of this area. He developed a corroboration argument — grounded in Commonwealth v. Forde, Commonwealth v. Leonard, and Commonwealth v. Latimore — challenging the Commonwealth’s ability to prove essential elements through an uncorroborated admission alone. He has used this argument to obtain three acquittals in gun possession cases where the defendant had admitted the gun was theirs. One of those cases was featured on the Another Not Guilty podcast, a national criminal defense podcast.

Suppression Motions — Challenging Unlawful Searches

Most Massachusetts gun cases are won or lost before trial through suppression motions. Ryan has been on both sides of these arguments — as a prosecutor drafting search warrants for police in Middlesex County, and as a defense attorney challenging them. He knows precisely where searches go wrong, and he presses those arguments hard.

A suppression motion in a firearms case resulted in the Commonwealth filing a Nolle Pros the morning of the scheduled suppression hearing — after the ADA reviewed BPD’s own inventory policy against the motion. Without that evidence, the case was dismissed.

Immigration Consequences of Criminal Convictions — Vacating Pleas

Ryan handles post-conviction cases for non-citizen defendants who were given wrong immigration advice by prior counsel. Under Padilla v. Kentucky, Clarke, and DeJesus, defense attorneys are constitutionally required to advise non-citizen clients of the specific immigration consequences of a guilty plea. When they fail — or give actively wrong advice — the plea can be vacated.

Ryan has vacated pleas that other attorneys could not. In one case, the same prosecutor’s office that successfully opposed a prior motion to vacate conceded Ryan’s motion when presented with the full factual and legal record he built.

Appellate Work and MACDL Legislative Advocacy

Ryan handles Massachusetts appellate matters in the Appeals Court and Supreme Judicial Court, including interlocutory Rule 15(a)(2) petitions and post-conviction motions for new trial. He is co-chair of the Legislative Committee of the Massachusetts Association of Criminal Defense Lawyers (MACDL), where he advocates before the Massachusetts Legislature on bills affecting criminal defendants across the Commonwealth.

National Press — ICE Enforcement and the Right to Trial

Ryan has been quoted by the Associated Press in two major immigration enforcement cases. In April 2025, he was quoted in national AP coverage of the ICE courthouse abduction of his client Wilson Martell-Lebron, who was seized by federal agents while his jury trial was actively underway at Boston Municipal Court. Ryan called the action “reprehensible” and filed a motion to dismiss with prejudice.

Ryan was also quoted in a separate AP story covering the detention of Juan Francisco Mendez in New Bedford, where ICE agents smashed a car window to seize a man they later claimed was not their intended target. Ryan secured a federal court order requiring the government to provide 72-hour notice before moving his client.
