Case Dismissed After Defense Exposes Coercive-Control Motive Behind False Domestic Assault Allegation

Our client came to us after prior counsel’s handling of the case nearly resulted in him being locked up at a dangerousness hearing. He had been accused of assault and battery on a family or household member, and the complaint application was treated as urgent enough that a warrant issued before he ever had a chance to defend himself.

By the time we were retained, the case had already done real damage. Our client was under strict pretrial conditions, including electronic monitoring, based on allegations that appeared serious on the surface.

But once we dug into the evidence, the story changed.

The police report showed that the case did not begin with the alleged victim walking into court asking for help. It began with the alleged victim’s ex-boyfriend and another person going to police, claiming she was in danger and asking for a well-being check. The report also reflected that the ex-boyfriend was deeply involved in driving the narrative, providing police with photographs, claims about alleged abuse, and information about our client’s immigration situation.

We were retained and immediately began reconstructing what had actually happened. Through screenshots, video, messages, and surrounding communications, we showed the prosecutor that the case was not what it first appeared to be. The evidence pointed to a thinly veiled plan by a jealous former boyfriend to regain coercive control over the “victim” by weaponizing the criminal process against her husband.

We marked the case for trial right away to minimize the disruption in our client’s life. There, we presented the Commonwealth with the problems in the proof: the lack of a reliable complaining witness, the role of the ex-boyfriend in generating the accusations, the contradictory communications, and the broader context showing manipulation rather than genuine criminal conduct.

The prosecutor dismissed the case.

The result ended the criminal prosecution, removed the threat of incarceration, and protected our client from the devastating consequences that can follow even an unsupported domestic-assault allegation.
